New ASC Legislation Introduced in the US House

US Representatives Devin Nunes (R-CA) and John Larson (D-CT) introduced the Ambulatory Surgical Center Quality and Access Act of 2013 (H.R. 2500) in the House of Representatives on Tuesday. This bill is the companion legislation to S. 1137, which was introduced by US Senators Ron Wyden (D-OR) and Mike Crapo (R-ID).

These bills would move the ASC reimbursement update factor from the Consumer Price Index for All Urban Consumers (CPI-U) to the hospital market basket update, which better measures the cost of medical expenses. The bills would also:

• create a value-based purchasing program for ASCs;

• add an ASC voice to the Advisory Panel on Hospital Outpatient Payment (which controls various aspects of physician payment rates); and

• require the Centers for Medicare & Medicaid Services (CMS) to disclose which criteria it uses to determine which procedures may be performed in the ASC setting.

Please contact your representatives and senators as soon as possible and ask them to become cosponsors of the ASC Quality and Access Act of 2013 to help build momentum around this important legislation.
